Disclosure to Banks

Employee information cannot be disclosed to financial institutions without the consent of the employee justified by section 28(2) of LAFOIP or section 10 of LAFOIP Regulations.

When information is disclosed with the consent of the employee it should be shared only with the specific institution authorized and only for the specific purposes and time period set out in the consent.

The consent should preferably be obtained in writing. In some circumstances, such as when the employee is present to provide information, the consent can be verbal but a note should be made that the consent was obtained.
