No information should be disclosed to an employee’s lawyer unless permission for its disclosure is obtained in writing. The consent should be kept on the file, together with a clear notation of the information that was released pursuant to the request.

In the course of a legal action the parties must disclose to each other all documents within their possession or control that might relate to the lawsuit. Section 28(2)(b) of LAFOIP provides that personal information may be disclosed.

An employee may wish to obtain a copy of the employment record and will usually provide their lawyer with a written consent.

Whenever an information request is made by a lawyer or for the purpose of a legal action it is recommended that the board of education consult with its own legal counsel before releasing the information.
