Disclosure to Other Boards of Education

There is no general authority for boards of education (board) to disclose employee files with other boards. Unlike the situation with student records, boards and other employers have not traditionally exchanged complete employee files when an employee changes jobs, nor is this consistent with the purposes for which the information was gathered. The transfer of the file does not fit within the exemptions set out in section 28 of LAFOIP.

In the case of teachers, even though the Provincial Collective Bargaining Agreement provides that the teachers Accumulated Sick Leave (ASL) record is portable from one board to another, the ASL record is to be provided directly to the teacher, not to another board.

The only limited access to personal information that may be provided to another board is for the purposes of providing a reference for the employee.
