Criminal Record Checks

Criminal records checks should be required from all employees before commencing employment. Such checks do not violate any privacy rights of the individual.

Criminal records checks are a reasonable and legitimate way for boards of education (board), which have a duty to protect students, to avoid hiring unsuitable employees.

Applicants for positions with the board should be informed in advance of board policy if criminal checks are required.

It is not necessary to have all applicants provide a record check. The checks can be required of employees once the decision to hire has been made and before they commence employment.

Boards should also consider doing similar checks for volunteers.
