Disclosure to Insurance Adjusters

Board of education (board) employees can provide the adjuster working for the board’s insurer with all relevant information that the adjuster might request. There is a contractual obligation with the insurers for boards. This would fall within the specific exception under section 28(2)(e) of LAFOIP which allows for the disclosure of information for the purpose of enforcing legal rights.

The insurer will be bound by contractual obligations, as well as the provisions of the federal privacy legislation (i.e. the Personal Information Protection and Electronic Documents Act), to ensure the privacy of the information.

Care should be taken to ensure that the adjuster requesting the information is working for the board of education. The same exception is not available when the adjuster or investigator is working for the potential claimant.
